TERMS & CONDITIONS
§ 1 Scope, Definitions

These General Terms and Conditions apply to all orders for services such as courses and private sessions (hereinafter also referred to as "courses and private sessions") and counselling services as well as digital products (hereinafter also referred to as " products") placed through the webpage www.bvm.is.

The contract is concluded between Besti Vinur Mannsins slf., Iceland, kennitala (registration number): 490623-0510, email: info[at]bvm.is (hereinafter referred to as "BVM") and a customer (hereinafter referred to as "customer").

§ 2 Formation of a Contract
​
By publishing the courses and private sessions as well as products on the webpage, a binding offer is made to conclude a contract for these services and products.
​
The contract is concluded by clicking on the button "check out" and therefore accepting the offer for the courses and private sessions and/or products in the shopping cart. Immediately after submitting the order, you will receive a confirmation by e-mail.
​
§ 3 Prices
​
Unless otherwise indicated, the prices quoted on the product pages are exclusive of the statutory value added tax (VAT exemption according to article 2, section 3 of the Icelandic Value Added Tax Act 1988 nr. 50 24. May (2. gr., 3. Lög um virðisaukaskatt 1988 nr. 50 24. Maí).

Any accommodation and/or travel and/or extra costs of third parties incurred by attending and/or using the courses and private sessions or products are not included in the price.
§ 4 Shipping Costs
​
There are no shipping costs for courses and private sessions as well as products, and all documents provided as part of the services will be available for download and/or sent through email.
​
§ 5 Terms of Payment
​
Payments for courses and private sessions as well as products must be made in advance and the payment process is provided through the webpage of BVM. There are no fees for payment.

§ 6 Delivery of services and products
​
6.1 Courses and Private Sessions
​
Courses and private sessions, either live or online, take place during the dates and times that are being published on the webpage or as booked/agreed upon between BVM and the customer. § 8 of the Terms and Conditions remains unaffected by this.
​
6.2 Products
​
Digital products are being delivered instantly through some form of a download.
​
Counselling services will be delivered within max. 8 weeks after the order has been placed or within the timeframe agreed upon between BVM and the customer.

§ 7 Customer's Right of Cancellation
​
7.1 Courses and Private Sessions
​
The customer can cancel a course or private session up to 72 hours before the start of the first course date or the date of the private session. The refund will be made in the amount of the original purchase price minus 30 %.
​
The customer can reschedule a course or private session up to 24 hours before the start of the first course date or the date of the private session. A refund is not applicable. In the case of rescheduling a course, the customer can attend the same or a different course in the future. The customer might be added to a waitlist if the rescheduled, paid course is not held regularly. In case of a price difference between the rescheduled, paid course and the future course, it needs to be paid accordingly by the customer or will be refunded by BVM.
In order to declare a cancellation or a rescheduling, the customer must send an e-mail to info[at]bvm.is and inform about the decision to cancel or reschedule in a clear statement. It is not necessary to provide reasons.

In order to comply with the cancellation period, it is sufficient to send the notification before the cancellation/rescheduling deadline.

If notified after the 72 or 24 hours` period, the price of the course or private session will not be refunded.
​
After a course or private session has started, it is not possible to get a refund, unless the refund is requested due to a sudden illness in which case a medical certificate must be provided. Courses and private sessions are not reimbursed due to absence and/or general/chronical illness.
​
7.2 Products
​
The order of products cannot be cancelled.
§ 8 Content, Re-scheduling, Change of Location and Trainers/Counsellors of courses and private sessions
​
BVM will inform participants in good time of any changes of dates, times and/or locations of courses and private sessions.
​
BVM reserves the right to postpone or cancel the events offered in the case of insufficient demand, undersubscription, understaffing, absence of the trainer or for other reasons for which BVM is not responsible. The affected participants will be informed immediately.
​
If a course or private session is cancelled entirely, the customer has the right for a full refund of the price of the course or private session. BVM has the right to offer alternative dates or services to replace the cancelled courses or private sessions, but there is no obligation on the part of the customer to accept this. However, any cancellation fees due for hotel bookings or travel expenses are at the expense of the customer.

BVM reserves the right to make changes or deviations from the content, methodology and organisation of a course or private session programme at short notice, provided that the benefit of the event remains unchanged for the participants.
BVM reserves the right to replace certain trainers/counsellors with other equally qualified trainers/counsellors.

§ 9 Exclusion of Liability

9.1 courses and private sessions

At any time, dogs and accompanying people such as children are the responsibility of the owner/guardian/handler. Besti Vinur Mannsins slf. is not responsible for accidents and/or damage caused by dogs, children or adults.
​
9.2 products
​
An exclusion of liability applies for feeding plans.
Nutritional coverage: In BARF feeding plans, some nutrients will usually not meet the required nutritional value for dogs and cats according to the current scientific information of the National Research Council (NRC). This applies in particular to the zinc and manganese requirements in adult animals, and to the calcium and phosphorus requirements in growing animals. An actual deficiency of these nutrients can have health consequences for animals. It should be noted, however, that the mentioned required nutritional values take into account a bioavailability of the nutrients of only 10-50%, i.e. it is assumed that 50-90% of the ingested nutrient is not absorbed by the cat´s/dog´s body. Animal owners who practice BARF usually assume that a feeding plan based on the structure of a prey animal (BARF) will not cause deficiencies, even if some of the required NRC-values for nutrients are not met, because they assume that the nutrients coming from BARF feeding are better absorbed as the aforementioned bioavailability is higher than is taken into account in the required NRC-values.

At the end of filling out the BARF food plan questionnaire, the customer is explicitly informed of this. The customer acknowledges and accepts the aforementioned information (some scientific nutritional requirements may not be met) and agrees to receive a feeding plan based on the BARF principle by ticking a check box at the end of the questionnaire.

§ 10 Copyright

10.1
Any session materials, video recordings, images and other accompanying materials offered by BVM are protected by copyright. The customer acknowledges and complies with the copyrights. No copyrights, rights of use or other rights for intellectual property of the content are transferred to the customer. The customer is only entitled to use the retrieved content for his own purposes. He is not entitled to make the content accessible to third parties or to make it available for exploitation. This applies particularly to publication on the internet, unless otherwise explicitly stated. Reproduction or other distribution and commercial reproduction of the contents is explicitly excluded. The customer is not allowed to remove copyright comments, trademarks and other legal reservations in the retrieved content.

10.2
If the customer violates one or more of the aforementioned obligations, he is obliged to pay an amount of ISK 100.000 (€ 680/USD 725) as a minimum damage for each singular instance. The compensation is to be set at a higher or lower rate if BVM proves a higher damage or the customer proves a lesser damage.

10.3
The obligation under § 10.1 remains in force even after the termination of the contractual relationship.

§ 11 Closing Provisions
​
Should any provision of these General Terms and Conditions be invalid, the remaining part of the contract shall remain valid. Instead of the invalid provision/s, the relevant statutory provisions shall apply.
